ARTICLE I - SCOPE
This Implementing Arrangement describes the scientific and tech-
nical activities to be undertaken by the National Taiwan Univer-
sity (NTU)/Institute of Oceanography, the designated representa-
tive of the Taipei Economic and Cultural Representative Office (
TECRO) in the United States, and the Pacific Marine Environment-
al Laboratory (PMEL) of the National Oceanic and Atmospheric Ad-
ministration (NOAA), the designated representative of the Ameri-
can Institute in Taiwan (AIT). It provides for refurbishment co-
sts for three next generation ATLAS moorings (acquired by NTU u-
nder Implementing Arrangements #1 and #2), technical assistance
for mooring deployment operations in the boreal spring 1999, as
part of the South China Sea Monsoon Experiment (SCSMEX) program,
and the return of a one lent next generation ATLAS mooring syst-
em to PMEL. This project is conducted under the Agreement for T-
echnical Cooperation in Ocean Climate Research between AIT and P
MEL.

ARTICLE II - AUTHORIZATION
The Taiwan Relations Act, 22 USC 3301-3316, authorizes agencies
of the United States Government to perform services for, and to
accept funds in payment from TECRO via AIT.
The National Climate Program Act, 15 USC 2901-2908, authorizes
the Secretary of Commerce to perform oceanic climate studies.
Under 15 USC 1525, the Secretary of Commerce is authorized to m-
ake special studies on matters within the authority to the Depa-
rtment, upon payment of the actual or estimated cost of such sp-
ecial work.
The activities described in this Implementing Arrangement will
be carried out under the general terms and conditions establish-
ed by the Agreement between TECRO and AIT for Scientific and Te-
chnical Cooperation in Ocean Climate Research. This Implementing
Arrangement is hereby attached to that Agreement and becomes pa-
rt of the Agreement.

ARTICLE III- SEIRVICES
The next generation ATLAS buoy was originally designed and fabr-
icated to support the Tropical Atmosphere-Ocean (TAO) Array of
moored ocean buoys in the tropical Pacific. The TAO Array, cons-
isting of nearly 70 moored buoys spanning the equatorial Pacifc,
measures oceanographic and surface meteorological variables cri-
tical for improved detection, understanding and prediction of s-
easonal-to-interannual climate variations originating in the tr-
opics, most notably those related to EI Nine/Southern Oscillati-
on (ENSO) events. These buoys provide climate researchers, weat-
her prediction centers, and scientists around the world with re-
al-time data from the tropical Pacific. During the period of Im-
plementing Arrangement #3, PMEL agrees to provide the following:
TECHNICAL ASSISTANCE:
PMEL, on behalf of AIT, as part of the field operations in bore-
al spring 1999, will provide assistance to deploy three next g-
eneration ATLAS moorings in the South China Sea. Costs to TECRO,
or its designated representative, NTU, involve travel (air fare
and per diem pursuant to Federal travel regulations) for one PM-
EL technician to travel to Taiwan for mooring cruise preparatio-
ns and for at sea participation in the deployment cruise itself.
It is assumed that this cruise will be no more than 15 days in
duration.
REFUBISHMENT COSTS:
Costs to TECRO, or its designated representative, NTU, incurred
under this category relate to refurbishment costs for three next
generation ATLAS moorings acquired by NTU under Implementing Ar-
rangements #1 and #2. Costs to be paid by TECRO, or its designa-
ted representative, are for the replacement of worn out, damaged
or expendable hardware (e.g., steel and nylon cable, anchor, etc
.); repair and preparation of the surface toroid for the next d-
eployment; replacement of damaged or lost instrumentation (e.g.,
electronics tube, temperature modules, etc.); and recalibration
of sensors prior to deployment. These refiubishments will be co-
mpleted at the facility of AIT's designated representative, PMEL
where the original NTU moorings will be shipped upon recovery.
Costs to TECRO, or its designated representative, NTU, for nece-
ssary hardware, instrumentation, etc. to perform this service w-
ill be US $30,000. Shipping of the recovered mooring systems to
the facility of AIT's designated representative, PMEL, and ship-
ping of the refurbished mooring systems back to Taiwan will be
covered by TECRO or its designated representative. Both surface
and air shipments may be required.
SPARE COMPONENTS:
The following details the current costs of spare electronics co-
mponents used in the next generation ATLAS moorings:

Additional costs to TECRO, or its designated representative, NTU
, may include spare mooring components to be provided to NTU by
AIT's designated representative, PMEL, under this arrangement.
Exact costs will be determined by actual circumstances or, in t-
he case of electronics tubes, by irreparable damage that requir-
es component replacement. Shipping of spare cozneonents from PM-
EL to NTU will be the responsibility of TECRO, or its designated
representative, NTU, and is not included in this arrangement.

ARTICLE IV - FLNANCLAL PROVISIONS
In accordance with the Agreement, PMEL is undertaking this work
on behalf of AIT for TECRO's designated representative, NTU. TE-
CRO, or its designated representative, will reimburse AIT for a-
ll costs incurred in association with this Implementing Arrange-
ment #3, and AIT will pass to PMEL all such reimbursements.
The total cost to TECRO, or its designated representative, NTU,
for activities described in this Implementing Arrangement is mu-
tually agreed to be US $30,000 for refurbishment, plus travel (
pursuant to Federal travel regulations) for one technician, plus
full reimbursement for any spare components provided by PMEL to
NTU. This amount is based upon TECRO or its designated represen-
tative independently paying all shipping charges between the fi-
eld of operations and Seattle, Washington both after recovery a-
nd prior to deployment.
TECRO and AIT acknowledge that the performance of AIT's designa-
te, PMEL, is subject to the availability of PMEL's funds.

ARTICLE V - INTELLECTUGL PROPERTY CONSIDERATIONS
No intellectual property considerations are expected to arise in
conjunction with activities described in this Implementing Arra-
ngement. Existing system aesigns and computer software of the P-
MEL next generation ATLAS mooring are in the public domain. Rep-
orts, specifications, and computer software prepared under this
Implementing Arrangement will also be in the public domain once
they have been approved in a final form by the NTU and NOAA.

ARTICLE VI - EFFECTIVE DATA, AMENDMENT, AND TERMINATION
This Implementing Arrangement is effective on the date of the l-
ast signature hereafter. This Implementing Arrangement may be a-
mended and/or tenninated in accordance with the terms of the Ag-
reement. The estimated completion date for the activities descr-
ibed in this Implementing Arrangement is May 31, 2000.
