Article 1
The Executive Yuan hereby establishes the Ministry of Agriculture (hereafter MOA) to handle administration of the farming, forestry, fisheries, and animal husbandry industries across Taiwan.
Article 2
The MOA shall be in charge of the following matters:
1. Planning, research, formulation, management, and supervision of agricultural policies, laws and regulations.
2. Planning, research, formulation, management, and supervision of policies, laws, and regulations for sustainable use of agricultural resources.
3. Planning, research, formulation, management, and supervision of policies, laws, and regulations for guidance of farmers.
4. Planning, research, formulation, management, and supervision of policies, laws, and regulations for the livestock industry and animal protection.
5. Planning, research, formulation, management, and supervision of policies, laws, and regulations for agricultural technology.
6. Planning, research, formulation, management, and supervision of policies, laws, and regulations for international and cross-strait agricultural trade and cooperation.
7. Planning, research, formulation, management, and supervision of policies, laws, and regulations for management of agricultural information and development of information and communications technology applications.
8. Supervision and guidance of subsidiary agencies in handling agriculture and food, fisheries, animal and plant health inspection and quarantine, forestry and nature conservation, soil and water conservation and rural development, irrigation, agricultural finance and agricultural insurance, and agricultural technology park affairs.
9. Supervision, coordination, and promotion of science and research by subordinate institutions in areas including agriculture, forestry, fisheries, animal husbandry, veterinary science and technology, agricultural chemicals, biodiversity, regional agriculture, plant seedlings, and special-use crops.
10. Other agriculture-related matters.
Article 3
The MOA shall have one Minister(political appointment); two Political Deputy Ministers equivalent to senior grade 14; and one Administrative Deputy Minister at senior grade 14.
Article 4
The MOA shall have a chief secretary with the rank of senior civil servant Grade 12.
Article 5
The subordinate agencies of the MOA and their duties shall be as follows:
1. Agriculture and Food Agency: Planning and implementation of agricultural and food policies and related management matters.
2. Fisheries Agency: Planning and implementation of fisheries policies and related management matters.
3. Animal and Plant Health Inspection Agency: Planning and implementation of animal and plant disease prevention, disease inspection, and livestock and poultry slaughtering policies and related management matters.
4. Forestry and Nature Conservation Agency: Planning and administration of forestry and nature conservation policies and related management matters.
5. Agency of Rural Development and Soil and Water Conservation: Planning and implementation of rural development and soil and water conservation policies and related management matters.
6. Irrigation Agency: Planning and implementation of farmland irrigation policies and related management matters.
7. Agricultural Finance Agency: Planning and administration of agricultural finance and agricultural insurance policies and related management matters.
8. Agricultural Technology Park Administration Center: Implementation of management matters for agricultural technology parks.
Article 6
To meet operational needs, the MOA may ask for approval from the Executive Yuan to dispatch personnel overseas to handle relevant matters; such assignments shall be handled on the basis of the “Organization Act of Diplomatic Missions of the Republic of China.”
Article 7
The number of personnel in the MOA and their ranks and grades shall be stipulated in a separate staffing chart.
Article 8
The Executive Yuan shall determine the date this Act comes into effect.
