沿革:
1.Signed on March 31, 2021
Entered into force on January 11, 2021
The Government of the Republic of China (Taiwan) and the
Government of the Kingdom of Eswatini, desiring to further
promote and strengthen the friendly relations between the two
countries by means of intensifying the existing technical
cooperation in the field of agricultural development in
Eswatini, have agreed to the following:
ARTICLE I
1. The Government of the Republic of China (Taiwan) undertakes
to maintain in the Kingdom of Eswatini the Technical Mission
(hereinafter referred to as “ the Mission ” )with the
number of its members as may be required and agreed upon
between the two Governments.
2. Being subject to the prior consent of the Chief of the Area
and as jointly determined by the two Governments, the Mission
undertakes:
(a) to demonstrate planting of such crops as rice varieties,
vegetables and other crops to be determined by the two
Governments at the project farms in the Kingdom of Eswatini;
(b) to demonstrate at project farms in the Kingdom of Eswatini
the rearing of small livestock or other livestock as
determined by the two Governments;
(c) to conduct extension works, for increasing agricultural
production in Eswatini, by providing information and advice
on improved agricultural techniques to the management staff
of the competent Swazi authorities and/or selected farmers
at places to be determined by the two Governments; and
(d) to assist the Government of the Kingdom of Eswatini in its
drive to enhance agricultural diversification and
commercialization so as to reduce its dependency on imports.
3. Any new project to be undertaken or any change to the
existing projects being undertaken by the Mission shall be
agreed upon by an exchange of notes between the two
Governments.
ARTICLE II
The Government of the Republic of China (Taiwan) undertakes:
1. to defray the travelling expenses to and from the Kingdom of
Eswatini and to pay the salaries of all members of the
Mission during the period of their service in the Kingdom of
Eswatini.
2. to supply the Mission with farming implements, tools,
fertilizers, seeds, pesticides and other materials needed for
its demonstration; further provision, for new projects, of
such machinery, equipment, seeds, fertilizers, pesticides,
and others needed for reclamation, irrigation and cultivation
shall be agreed upon between the two Governments; and
3. to hand over to the Government of the Kingdom of Eswatini for
disposal all agricultural products of the Mission in excess
of the amount required for demonstration, official use and
consumption by the Embassy of the Republic of China (Taiwan)
in the Kingdom of Eswatini and the Mission.
ARTICLE III
The Government of the Kingdom of Eswatini undertakes:
1. to provide adequate land for the Mission in carrying out its
work as specified in Article I, 2, (a) and (b) of this
Agreement;
2. to provide the Mission with one motor vehicle for each of the
projects and to pay for the repair, maintenance and insurance
costs of these vehicles;
3. to provide and pay for the labour required for reclamation
and construction works, and the drivers required for the said
vehicles under this Article;
4. to provide members of the Mission in each of the projects
with appropriate furnished living quarters with water and
electricity;
5. to exempt from all import, customs, sales and other duties
and taxes on all items referred to in Article II, 2 of this
Agreement; and
6. to grant members of the Mission:
(a) exemption from taxation on their salaries and allowances;
(b) exemption from all imports, customs and other duties and
taxes on their personal and household effects and first-time
vehicle purchases on their first arrival in Eswatini;
(c) medical treatment shall be on the same terms as granted to
civil servants employed by the Government of the Kingdom of
Eswatini; and
(d) equal treatment, for other points not specifically covered
under this Article, as that awarded to members of a mission
of any third country serving in the Kingdom of Eswatini on a
technical cooperation project for the development of
Eswatini.
ARTICLE IV
1. This Agreement shall enter into force on the date of its
signature by both Parties, and its effect will be retroactive
to January 11, 2021 and may be amended in writing notice by
the mutual consent of the Parties.
2. This Agreement remains effective until either Party notifies
the other Party in writing of its intention to terminate this
Agreement. The termination will become effective six months
after the date of the said notice.
3. This Agreement is done in duplicate in the Chinese and
English languages, both texts being equally authentic.
IN WITNESS WHEREOF, the undersigned, being duly authorized
thereto by their respective Governments, have signed this
Agreement.
Done at Mbabane on this 31st day of the Third month of the 110
year of the Republic of China (Taiwan), corresponding to the 31
day of March of the year 2021
