Entered into force on August 03, 2021
The Taipei Representative Office, Bratislava and the Slovak
Economic and Cultural Office, Taipei (hereinafter referred to as
the “ Participants ” );
Emphasizing the significance and usefulness of the dialog
concerning issues of mutual interest;
Desiring to improve collaboration in the field of mutual legal
assistance in criminal matters and extradition (hereinafter the
“ Criminal Judicial Cooperation ” );
Have reached the following arrangement:
Section 1
Scope
The objective of this Arrangement is to seek the most effective
means and mechanisms to enhance the mutual collaboration and
Criminal Judicial Cooperation, including via authorities listed
in the Annex to this Arrangement (hereinafter the “ Contact
Authorities ” ).
The Contact Authorities will seek, with full respect to the
applicable norms and principles of their domestic legal orders,
to
a) adhere, where possible, to the principle of reciprocity when
considering the requests for Criminal Judicial Cooperation,
b) exchange relevant information regarding their national laws
related to or otherwise relevant for the Criminal Judicial
Cooperation and,
c) share experience on practical aspects of the cooperation
under this Arrangement.
Section 2
Mutual Legal Assistance in Criminal Matters
1. The principle of reciprocity will be taken into
consideration, with full respect to the norms and principles
of the applicable legal order, when processing the requests
for mutual legal assistance in criminal matters.
2. It will be endeavoured to provide assistance pursuant to this
Arrangement as expeditiously as possible in accordance with
domestic laws and procedures.
Section 3
Extradition
The principle of reciprocity will be taken into consideration,
with full respect to the norms and principles of the applicable
legal order, when processing the requests for extradition
including the requests for provisional arrest.
Section 4
Bilateral Consultations
1. The Contact Authorities will seek to hold regular bilateral
consultations with a view to examine other avenues to promote
their collaboration in the area of Criminal Judicial
Cooperation and to exchange views on relevant issues of
mutual interest.
2. The exchange of views could focus, inter alia, on
a) exploration of the opportunities for further expanding and
deepening bilateral relations, and the judicial cooperation
in criminal area; and
b) examination of other issues and problems in the field of
criminal justice of mutual interest.
Section 5
Communication
In the implementation of this Arrangement, the Contact
Authorities may communicate directly or through the
Participants.
Section 6
Processing of Personal Data
As regards the protection of personal data received on the basis
of this Arrangement, Participants and Contact Authorities will
endeavour to adhere to global standards on the protection of
individuals with regard to the processing of personal data.
Section 7
Relation to Applicable Laws
This Arrangement does not affect any rights and obligations
arising out of domestic laws and international treaties.
Section 8
Final Provisions
1. This Arrangement will come into effect on the day of its last
signature by both Participants and will remain in effect
until terminated in accordance with paragraph 3 of this
Section.
2. This Arrangement may be amended by mutual consent of the
Participants in writing. Such amendments will come into
effect upon confirmation as specified therein.
3. Either Participant may terminate this Arrangement at any time
by giving a written notification to the other Participant.
Such termination will take effect six months after the date
of receipt of such notification.
