法規名稱: AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF CHINA (TAIWAN) AND THE GOVERNMENT OF THE REPUBLIC OF NAURU ON POLICE COOPERATION

The Government of the Republic of China (Taiwan) and the
Government of the Republic of Nauru, hereinafter referred to
individually as a “ Party ” and collectively as the “ Parties
”;

WISHING to promote cooperation between law enforcement of both
countries;

BEING concerned about policing development and prevention of
transnational crime;

ACTING on the principle of equality and reciprocity;

Hereby have agreed as follows:

Article 1
Competent Authorities
1.1 The competent authorities that implement this Agreement are:
(a) The National Police Agency of the Ministry of the Interior
of the Republic of China (Taiwan); and
(b) The Police Force of the Republic of Nauru.
1.2 The Parties shall dedicate themselves to engaging in
exchange activities and cooperation in accordance with their
respective domestic laws and regulations, as set out in the
provisions of this Agreement and as required in their
official responsibilities and functions.

Article 2
Purpose
This Agreement sets out the framework for cooperation between
the Parties in developing police cooperation and combating
transnational crimes.

Article 3
Scope of Cooperation
The Parties agree to seek the possibility of cooperation in the
following areas:
(a) The exchange of personnel visiting;
(b) The exchange of personnel for study purposes;
(c) Training programs for police professional techniques;
(d) The exchange of working experience and technical assistance;
(e) The sharing and exchange of information in the area of law
enforcement;
(f) Cooperation in Combating transnational crimes;
(g) To implement other areas of cooperation as agreed upon by
the Parties.

Article 4
Forms of Cooperation
To ensure the effective implementation of this Agreement, the
Parties shall cooperate as follows:
(a) To engage personnel in Drug Analysis Training;
(b) To send personnel for Close Protection Personal Training;
(c) To send personnel for Police Traffic Unit Courses or
Training;
(d) Arrange for personnel to undergo Cyber Crime Investigation
training or courses;
(e) Allow for personnel to be trained locally or abroad on
Criminal Investigation Courses in the area of Homicides,
Fraud, Offences against Women and Children;
(f) Arrange for personnel to undergo training as a Police
Armourer for the maintenance and upkeep of Nauru Police
firearms.
(g) Arrange for any Transnational Crime Training locally or
abroad that has not been mentioned in the areas above.

Article 5
Settlement of Disputes
Any dispute arising out of the interpretation or implementation
of this Agreement shall be settled amicably through consultation
or negotiation between the Parties or diplomatic channels.

Article 6
Relations of this Agreement with other International Instruments
This Agreement shall not prejudice the right and obligation
stemming from other international instruments to which both
parties are a party to.

Article 7
Entry into Force, Termination and Amendment
7.1 This Agreement shall enter into force on the date of
signature of the Parties.
7.2 Either Party may terminate this Agreement at any time by
giving the other Party thirty (30) days prior notice in
writing of its intention to terminate.
7.3 This Agreement may be revised or amended at any time by the
written consent of the Parties. Such revision or amendment
shall enter into force immediately upon agreement or on such
date as may be determined by the Parties.

Article 8
Language
The competent authorities, in the course of their cooperation in
accordance with this Agreement, will use English as the medium
of communication.

Article 9
Expenses
The expenses incurred for the implementation of this Agreement
shall be borne by the respective Parties, unless otherwise
agreed by the Parties.

IN WITNESS WHEREOF the undersigned, being duly authorized by
their respective Governments, have signed this Agreement.

Done in duplicate on Sep. 20. 2018 at Taipei in the Chinese and
English languages, both texts being equally authentic.
