For any Biobank established prior to the enforcement of Human Biobank Act, its Operator shall, within no later than February 5, 2012, complete all necessary corrective actions to conform to Human Biobank Act. Those who fail to undertake complete corrective actions within the time specified shall destroy and may not re-use any and all biological specimens and related data and information. However, in the event that the corrective action may not be completed due to the death or incapacity of the Participant, the biological specimens and related data and information may be preserved with the approval of the ethics committee and the Competent Authority.

The Human Biobank Act shall become effective as of the day of promulgation.
