Dear Mr. MacIntosh:

I have the honour to refer to the recent discussions between
representatives of the Canadian Trade Office in Taipei (CTOT)
and the National Communications Commission (NCC) on the subject
of the implementation of Phase II of the Asia-Pacific Economic
Cooperation Mutual Recognition Arrangement for Conformity
Assessment of Telecommunications Equipment (APEC TEL MRA). The
purpose of this letter is to confirm our common understandings
of the arrangements that will apply to the implementation of
Phase II of the APEC TEL MRA. To this end, it is the
understanding of NCC that the following will apply:
1.NCC confirms that it is prepared to initiate implementation of
the general provisions, Appendix A, and Phase II Procedures in
Appendix C of the APEC TEL MRA with the Department of Industry
of Canada (IC). Specifically, NCC will apply Phase II
Procedures for the recognition of Certification Bodies (CBs)
designated by IC and for the acceptance of equipment
certifications certified by those CBs for equipment subject to
the regulations of Chinese Taipei regarding:
telecommunications, electromagnetic compatibility (EMC) and
electrical safety. NCC will also apply Phase II Procedures for
the designation of Chinese Taipei's CBs to certify equipment
subject to radiocommunications regulations of Canada.
2.Annex I of the Phase II Procedures of the APEC TEL MRA (List
of Technical Regulations for Chinese Taipei) is attached as
the list of Technical Regulations for which NCC will accept
equipment certifications certified by recognized CBs of
Canada. Any modifications to this list will be notified in
accordance with the general provisions of the APEC TEL MRA
which is an integral part of this letter.
3.NCC will be the telecommunications Regulatory Authority
responsible for recognizing CBs designated by IC under the
APEC TEL MRA. Also, NCC will be the Designating Authority for
Chinese Taipei CBs requesting recognition by IC under Phase II
of the APEC TEL MRA.
4.CTOT confirms that IC is prepared to initiate implementation
of the general provisions, Appendix A, and Phase II procedures
in Appendix C of the APEC TEL MRA with NCC. Specifically, IC
will apply Phase II Procedures for the recognition of CBs
designated by NCC and for the acceptance of equipment
certifications certified by those CBs for equipment subject to
radiocommunications regulations of Canada. IC will also apply
Phase II Procedures for the designation of Canadian CBs to
certify equipment subject to regulations of Chinese Taipei
regarding: telecommunications, EMC and electrical safety.
5.Annex I of the Phase II Procedures of the APEC TEL MRA (List
of Technical Regulations for Canada) is attached as the list
of Technical Regulations for which IC will accept equipment
certifications certified by recognized CBs of Chinese Taipei.
Any modifications to this list will be notified in accordance
with the general provisions of the APEC TEL MRA.
6.IC will be the telecommunications Regulatory Authority
responsible for recognizing CBs designated by NCC under the
APEC TEL MRA. Also, IC will be the Designating Authority for
Canadian CBs requesting recognition by NCC under Phase II of
the APEC TEL MRA.
7.Both IC and NCC understand that as part of the implementation
of the APEC TEL MRA, the necessary exchanges of technical
criteria and related information for accrediting CBs will take
place.
8.At the commencement of this Phase II implementation, NCC and
IC may designate and recognize CBs in accordance with the
general provisions, Appendix A and Appendix C of the APEC TEL
MRA.
If the foregoing arrangements are acceptable to you, I have the
honour to suggest that this letter and your reply be placed on
record as the understanding of NCC and CTOT in this matter and
come into effect on the date of your reply.

I hereby acknowledge receipt of your letter dated March 28th,
2007 concerning the implementation of Phase II of the APEC TEL
MRA and have the honour to confirm that the arrangements set out
therein are acceptable to the Canadian Trade Office in Taipei
(CTOT), and that your letter and this reply will place on record
the understanding of CTOT and the National Communications
Commission in this matter and will come into effect April
3rd,2007.
