Article 1
The following regulations are enacted in accordance with the R.O.C. Act for the Establishment and Management of Free Ports, section 33, subsection 4.
Article 2
Individuals, vehicles and goods must be accompanied by appropriate permit credentials and submit to inspection at a perimeter checkpoint before being allowed into or out of the Port of Kaohsiung’s Free Trade Zone (hereafter, “KFTZ”). Individuals and vehicles must display an entry/exit permit, issued and administered by the Kaohsiung Harbor Bureau, MOTC (hereafter, “KHB”) when entering or leaving the KFTZ. Those holding still valid Port of Kaohsiung transit permits may use these to enter and exit the KFTZ. Goods may pass into or out of the KFTZ only when accompanied by relevant permit documentation.
Article 3
The various KFTZ entry / exit permits are named and defined as follows:
a. KFTZ Entry/Exit Permit (Long-Term): for persons whose work necessitates regular access to the KFTZ.
b. KFTZ Vehicle Access Permit (Long-Term): for vehicles that, due to business in the KFTZ, require regular access to the Free Trade Zone.
c. KFTZ Entry/Exit Permit (Limited Duration): for persons whose work requires access to the KFTZ for a limited period of time.
d. KFTZ Vehicle Access Permit (Limited Duration): for vehicles requiring short-term access to the KFTZ for valid business reasons.
e. KFTZ Entry/Exit Permit (Temporary Pass): for persons requiring temporary access to the KFTZ for business or some other discrete activity.
f. Vehicle Access Permit (Temporary Pass): for vehicles requiring temporary access to the KFTZ in the conduct of business or some other discrete activity.
Article 4
Individuals in the following categories are eligible to apply for Long-Term KFTZ Entry / Exit Permits:
a. Employees of either the international port or Free Trade Zone administrations who, in the course of their work, require frequent access to the KFTZ.
b. Employees of public agencies, port service providers and companies with their place of business within the KFTZ.
c. Other personnel requiring long-term and regular access to the KFTZ.
Individuals in the following categories are eligible to apply for Limited Duration KFTZ Entry / Exit Permits:
a. Employees assigned to limited-term construction, repair or maintenance projects within the KFTZ.
b. Employees of firms contracted to do work for public agencies, port service providers or companies located within the KFTZ and who consequently require access to the KFTZ.
c. Other personnel requiring access to the KFTZ for a limited duration of time.
An applicant data sheet (for standardized format, see appendices 1 and 2) must accompany requests for long-term and limited duration access permits. The sponsoring agency (or company) should forward completed applications to the KFTZ administration for review.
Article 5
Requests for long-term and limited duration vehicle access permits must be accompanied by an application form (see appendices 3 and 4), a copy of the motor vehicle license for each vehicle noted, as well as other supporting documentation and be submitted to the KFTZ administration for review and approval.
Article 6
Each long-term and limited duration access permit (individual and vehicle) issued by the KFTZ will bear a permit expiration date. Applicants are responsible to request a permit validity period that reflects their actual KFTZ access needs. Limited Duration access permits (for both individuals and vehicles) can be valid for up to six months. Long-Term access permits (for both individuals and vehicles) can be valid for up to five years. The KFTZ administration will assign individual validity periods for permits based on each applicant’s specific Free Trade Zone access requirements.
Article 7
Instructions for obtaining a temporary access pass (for individuals and vehicles) follow:
a. KFTZ Entry/Exit Permit (Temporary Pass): Applications for temporary pass access to the KFTZ for individuals (see appendix 5) should be filled out and submitted by public agencies, port service providers or companies operating in the KFTZ. The temporary pass must be returned when the individual exits the Free Trade Zone.
b. KFTZ Vehicle Access Permit (Temporary Pass): Applications for temporary pass access to the KFTZ for vehicles (see appendix 6) should be filled out and submitted by public agencies, port service providers or companies operating in the KFTZ. The temporary pass must be returned when exiting the KFTZ.
Anyone who loses a temporary pass must sign an affidavit that is countersigned by the permit sponsor before exiting the KFTZ (see appendix 7). The KFTZ administration will then designate the lost permit as invalid for future use.
Article 8
Goods entering or exiting the KFTZ should be accompanied by relevant transit documentation or electronic instructions and must be made available for inspection at a KFTZ perimeter checkpoint. Only goods approved through this procedure will be allowed to pass.
KFTZ container (cargo) entry/exit procedures will be handled in accordance with Regulations Governing Customs Clearance in Free Trade Ports.
All transit documentation and electronic instructions submitted for goods passing into or out of the KFTZ will be kept on file for one year.
Article 9
Should a long-term or limited duration access permit be lost, the bearer’s agency or company must submit a formal statement (see appendices 8 and 9) to confirm the loss and apply for a replacement.
Article 10
Should the bearer of a long-term or limited duration access permit leave his/her employer, the employer is responsible to repossess and return his/her permit to the KFTZ administration. Should the employer take no action, the KFTZ administration will, after appropriate notification, revoke the permit’s validity unilaterally.
Article 11
Should an access permit become damaged or illegible, the bearer should turn it in and apply for a replacement.
Article 12
Individuals outside the following categories are forbidden to reside in the Port of Kaohsiung Free Trade Zone:
a. Personnel serving in essential administrative, security and staffing positions. A relevant application (see appendix 10) should be filled out by their agency/company and submitted to the KFTZ administration for review and approval.
b. Businesspersons required to reside in the KFTZ. An employer with business operations in the KFTZ should submit to the KFTZ administration an application for a short duration or long-term access permit (see appendices 5 and 2) and a statement (see appendix 10) regarding the businessperson’s responsibilities and personal information. Approval of the residence request and access permit may be collected at the same time.
c. Other individuals who, due to work, safety, or maintenance and repair responsibilities, must reside within the KFTZ. Residency will be approved only after the applicant has filled out and submitted to the KFTZ administration a formal request (see appendix 10) for review.
Article 13
Individuals submitting residency applications (per section 12 above) who are not R.O.C. nationals (including those from Mainland China, Hong Kong and Macau), must also submit the following documents to the KFTZ administration as part of their application:
a. Passport or travel documents;
b. Alien Resident Certificate (ARC) or certificate of migrant worker status; and
c. Statement of needs documentation issued by an administrative, operational, or commercial entity located in the KFTZ.
Article 14
An individual involved in any of the following will have his/her permit cancelled and his/her long-term (or limited duration) KFTZ access permit revoked by the KFTZ administration. In addition, the said individual will be barred for a period of six months from resubmitting a new permit application.
a. In police detention while under investigation;
b. The forging, alteration, or misuse of any access permit;
c. The lending of a long-term or limited duration access permit to another individual;
d. Demonstrated involvement in smuggling and/or the sale of contraband;
e. Seriously obstructing the administration and/or operations of the KFTZ.
Article 15
Fees due for approvals, the replacement of lost permits, changes in permitted personnel, and the issuance of limited duration and long-term access permits are fixed in accordance with Port of Kaohsiung Free Trade Zone Fee Collection Regulations.
Article 16
This regulations document will take effect immediately upon promulgation.
