Article 1
The Executive Yuan shall establish the National Development Council
( hereinafter referred to as the NDC) to administer planning, coordination, review and resource allocation for national development.
Article 2
The NDC shall be in charge of the following matters:
1. Overall planning, coordination, review and resource allocation for national development policy.
2. Overall planning, coordination, review and resource allocation for national development plans and coordination of gender equality impact assessments for mid-term and long-term projects.
3. Overall planning, coordination, review and resource allocation for economic development policy.
4. Overall planning, coordination, review and resource allocation for social development policy, and guidance and assistance to local governments for the implementation of main policy and mid-term and long-term projects.
5. Overall planning, coordination, review and resource allocation for industrial development policy.
6. Overall planning, coordination, review and resource allocation for human resources development policy.
7. Overall planning, coordination, review and resource allocation for national land, regional and offshore island development and sustainable development policy.
8. Overall planning, coordination, review and resource allocation for cultural and ethnic development policy.
9. Overall planning, coordination, review and resource allocation for supervision and evaluation policy.
10. Overall planning, coordination, review and resource allocation for administrative and regulatory reform policy, and coordination of regulatory impact assessments.
11. Overall planning, coordination, review and resource allocation for other national development policy.
Article 3
The NDC shall have one chairman, who shall concurrently be a Minister without Portfolio of the Executive Yuan; and three vice chairmen, of whom two shall be equivalent to grade 14 and the other at grade 14.
The NDC shall consist of no fewer than 17 and no more than 27 Council Members, designated by the Executive Yuan Premier from among the Executive Yuan Ministers without Portfolio, Secretary-General, Minister of Finance, Minister of Economic Affairs, Minister of Transportation and Communications, Minister of Labor, Minister of Agriculture, Minister of Health and Welfare, Minister of Environment, Minister of Culture, Minister of Science and Technology, Chairperson of the Financial Supervisory Commission, Chairperson of the Council of Indigenous Peoples, Chairperson of the Hakka Affairs Council, Director-General of the Directorate-General of Budget, Accounting and Statistics, Governor of the Central Bank, and the heads of other relevant ministries and commissions, and serving concurrently thereas.
Article 4
The NDC shall have one Secretary-General at grade 12.
Article 5
The NDC shall establish the National Archives Administration, to deal with the management and use of government agency records.
Article 6
The official ranks, grades and number of positions of the NDC staff shall be set forth by a separate personnel establishment table.
Article 7
Prior to the enforcement of this Act, the personnel without civil service qualification who have been approved for registration in accordance with the Temporarily Assigned Personnel Assignment Act may retain the civil service ranks and occupational grades of their original job titles until the end of employment.
Article 8
The date of enforcement of this Act shall be prescribed by the Executive Yuan.
