CHAPTER VI PENAL PROVISIONS
Article 44
For a violation of Article 10, paragraph 1, the offender shall be punished with an administrative fine of not less than NT$500,000 and not more than NT$2.5 million.
When any of the following circumstances applies to a CMO, it shall be punished with an administrative fine of not less than NT$100,000 and not more than NT$500,000:
1. Evading, hindering, or refusing an audit, inspection, or order by the specialized agency in charge of copyright matters, in violation of Article 41, paragraph 3.
2.Violation of an order given or other required measures imposed by the specialized agency in charge of copyright matters pursuant to Article 41, paragraph 4.
3.Failure to make correction within the prescribed deadline in accordance with an order given pursuant to Article 42, paragraph 1.
The administrative fines under the preceding two paragraphs may be imposed for each successive infraction until correction is effected.
Article 45
When any of the following circumstances applies to a CMO and is of a material nature, and the CMO has still failed to make corrections after receiving a penalty under paragraph 2 of the preceding article, the specialized agency in charge of copyright matters shall revoke its establishment permit:
1. Unauthorized use of member royalty allocations, in violation of Article 38, paragraph 1.
2. Failure to distribute royalties, in violation of Article 38, paragraph 2.
3. Other violation of law or regulation or its articles of organization.
If a CMO, in violation of an order under Article 42, paragraph 2, fails to replace from office the director, supervisor, or complaint committee member who committed the unlawful act, and the circumstances are serious, the specialized agency in charge of copyright matters furthermore shall revoke its permit.
