These Regulations are enacted in accordance with Paragraph 2 of Article 58 of the Dental Technicians Act (hereinafter referred to as the Act).
These Regulations are applicable to all assistant dentists who obtained an assistant dentist certificate in accordance with the Regulations Governing Assistant Dentists before the Act was promulgated and enforced, as set forth in Paragraph 1 of Article 58 of the Act.
In case of damage to or loss of their assistant dentist certificates, assistant dentists shall apply to the central competent authority for replacement or reissuance thereof.
Any person who applies for replacement due to damage to their certificate, as set forth in the preceding paragraph, shall return the original certificate. Any person who applies for reissuance due to loss of their certificate shall sign an affidavit, and shall return the lost certificate immediately after it is recovered.
For the purpose of practicing and conducting business, an assistant dentist shall submit their assistant dentist certificate, three photographs of themselves, license fees, and proof of membership of an association to the municipal or city/county competent authority in order to apply for registration of their practice and business and issuance of licenses.
In the event of suspension, closure, or resumption of business, change of the name of a dental clinic, or change of the place of practice or business, an assistant dentist shall, within ten days from the date of occurrence of such an event, report the event to the municipal or city/county competent authority that issued their practice or business license for recording purposes. In case of death, their closest family member or the association concerned shall report such an event to the aforesaid competent authority for recording purposes. The competent authority shall then cancel the practice license, business license, and assistant dentist certificate of the deceased.
An assistant dentist shall, in the course of practice, prepare logs and registers to record the name, age, occupation, and address of patients as well as the types of dental restoration and prosthetic work.
The logs and registers set forth in the preceding paragraph shall be retained for ten years.
The scope of practice for assistant dentists shall be limited to dental restoration and prosthetic work.
Assistant dentists shall not perform oral surgery or engage in dental treatment.
If an assistant dentist falls under any of the following circumstances, the municipal or city/county competent authority that issued their licenses may annul their practice and business licenses:
1. Engaging in misconduct in practice;
2. Being deemed by the municipal or city/county competent authority to be unable to practice as an assistant dentist due to objective reasons.
After the second circumstance set forth in the preceding paragraph no longer exists, the assistant dentist may still apply for issuance of new practice and business licenses in accordance with Article 4.
Any assistant dentist subject to annulment or revocation of their practice or business license shall, within ten days from the day when the administrative sanction is imposed, hand their license back to the municipal or city/county competent authority that issued the license.
These Regulations shall come into effect on the date of promulgation.
