The Two Ministries of Communications in the Republic of China
and
The Kingdom of Saudi Arabia;
In pursuance of their desire to cooperate in the field of roads
and transport, His Excellency the Minister of Communications, K-
ingdom of Saudi Arabia, discussed with His Excellency the Vice
Minister of Communications, Republic of China during the latter-
's visit to the Kingdom, the subject of providing the Ministry
of the Kingdom of Saudi Arabia with a number of Chinese experts
in the above mentioned fields.
Consequently the Saudi Ministry has received from the Chinese E-
mbassy in Jeddah a letter with a list of the names of expects n-
ominated by the Ministry of Communications together with their
proposed monthly salaries ranging from $2793 to $3077 according
to the experience and qualifications of the Expert.
In accordance with the decree No. 1008 dated 10/7/1397 H of the
Saudi Council of Ministers to enter into an agreement with the
Chinese Ministry of Communications to provide the experts selec-
ted by Chinese Ministry of Communications within the limits of
the proposed salaries;
And based on the Agreement concluded between His Excellency the
Deputy Minister of Communications, Kingdom of Saudi Arabia and
the Superintendent of the Technical Affairs, Ministry of Commun-
ications, Republic of China, dated 26/12/97 (7/12/77) in which
the proposed salary of each expert was indicated;
It was agreed on the following:
ARTICLE ONE-PURPOSE OF THE AGREEMENT
The Chinese Ministry of Communications shall provide the Saudi
Ministry of Communications with experts in the field of roads a-
nd transport.
ARTICLE TWO-SELECTION OF THE EXPERTS
The experts shall be selected according to the following proced-
ures:
1 The Saudi Ministry of Communications shall send to the Chinese
Ministry of Communications a list showing the number of exper-
ts it needs and the required specialization.
2 The Chinese Ministry of Communications shall nominate the exp-
erts required for this purpose and also furnish the Saudi Min-
istry of Communications copies of the academic qualifications
and experience of each expert with brief summary of the posts
and jobs undertaken by him as well as the research work done
by him, if any, along with the number of his family members w-
ho will reside with him in the kingdom.
3 The Saudi Ministry of Communications shall select the expert
and determine his salary in compliance with the basis agreed
upon as described hereinafter and shall notify the Chinese Mi-
nistry of Communications of his name in order to take the nec-
essary action for his admission to the Kingdom.
4 Each expert shall be entitled to his salary from the date on
which he departs his country of domicile to Saudi Arabia prov-
ided that he starts to perform his duties in the Kingdom with-
in a period of three days from his departure.
ARTICLE THREE-FINANCIAL RIGHTS OF THE EXPERT
1 The expert shall receive a monthly salary ranging between US$-
2793 and 3077 which will be determined according to the acade-
mic qualifications and experiences of the expert. The salary
shall be paid as follows:
(a) A monthly salary inclusive of the local insurance, termina-
tion compensation and overseas allowance, which will be eq-
uivalent to one and a half times of the salary fixed to his
counterpart in the Kingdom according to the Non-Saudis Emp-
loyment Contract. This salary will be paid at the end of e-
ach Arabic month.
(b) Annual housing allowance of S.R. 32,500 to be paid at the
beginning of each year served in the Kingdom. This allowan-
ce constitutes the total of the monthly allowance agreed u-
pon which represents S.R. 2,625 per month for a full year.
In case the experts' services are terminated for any reason
before the end of the year, the Saudi Ministry of Communic-
ations shall regain from the expert an amount equal to the
remaining period of the year.
(c) The Saudi Ministry of Communications shall provide a maxim-
am of four economy class air tickets for the expert and his
family members accompanying him who are legally supported
by him during his service in the Kingdom for one time betw-
een Taipei and Riyadh at the time of his first admission to
the Kingdom and at the time of final departure at the end
of the services.
(d) S.R. 350 monthly as transportation allowance.
Total sum paid to the expert for the above mentioned four
items shall not be less than US$2793 and shall not exceed
US $3077 monthly.
2 Any thing not provided for above shall be totally governed by
the stipulations of "The Non Saudis Employment Contract".
Any compensations for additional service, deputations and com-
pe nsation for leaves shall be determined according to the ba-
sic salary only.
ARTICLE FOUR-METHOD OF SALARY PAYMENT TO THE EXPERT
The Saudi Ministry of Communications shall pay directly to the
expert his salaries and privileges set forth in Article three of
this agreement and on the basis specified therein, after his ad-
mission to the job in the Ministry.
ARTICLE FIVE-EXPERT'S SUBJECT TO REGULATIONS IN THE KINGDOM
In performing his duties in the Kingdom, and in respect of his
tasks, penalties commensurate, termination of service, etc.., t-
he expert shall be subject to all Civil Service Regulations and
the Rules of Public Employment of Non-Saudis personnel Discipli-
nary Regulations or others.
ARTICLE SIX-TEAM ORGANIZATION
The Chinese Ministry of Communications shall organize the team
and appoint leader from the present experts to look-after their
activities,
ARTICLE SEVEN-COPIES OF THE CONTRACT
This contract has been drawn up in two copies, one copy for each
Ministry.
