Arrangement on a Working Holiday Scheme between the Taipei Econ-
omic and Cultural Office, New Zealand and the New Zealand Comme-
rce and Industry Office

The Taipei Economic and Cultural Office, New Zealand and the New
Zealand Commerce and Industry Office (hereinafter referred to as
the "parties") have approved an Arrangement on the operation of
a Working Holiday Scheme (hereinafter referred to as the "Scheme
") between the parties. The purpose of the Scheme is to enhance
cultural and people-to-people contacts between Taiwan and New
Zealand in order to promote mutual understanding.
Scope of this Arrangement
1.For the purposes of this Arrangement
(a) "Taiwan" means the territory in respect of which the immigr-
ation laws administered by the Ministry of Interior, Taipei
are applied at the date of signature of this Arrangement.
(b) "New Zealand" means the territory in respect of which the
immigration laws administered by the New Zealand Immigration
Service, Department of Labour, Wellington, are applied at
the date of signature of this Arrangement.
Responsibilities of the New Zealand Commerce and Industry Office
2.The New Zealand Commerce and Industry Office through a New Ze-
aland visa processing office may facilitate the issuing of a
multiple work visa valid for a period of twelve (12) months
from the date of issue to any applicant from Taiwan who satis-
fies each of the following requirements:
(a) is a person who holds a Taiwan passport valid for more than
twelve (12) months upon arrival in New Zealand and who has
household registration under the laws of Taiwan;
(b) satisfies the visa officer that his/her primary intention is
to holiday in New Zealand, with employment being an inciden-
tal rather than a primary reason for the visit and will dep-
art New Zealand at the end of the visit;
(c) is aged between eighteen (18) and thirty (30) years, both
inclusive, at the time of application;
(d) has no accompanying children;
(e) holds a return ticket, or sufficient funds to purchase such
a ticket;
(f) has sufficient funds for his/her maintenance during the per-
iod of stay in New Zealand, at the discretion of the releva-
nt authorities;
(g) pays the prescribed work visa application fee;
(h) has valid medical and comprehensive hospitalisation insuran-
ce throughout his/her stay in New Zealand;
(i) has not been a previous recipient of a New Zealand working
holiday visa.
3.The New Zealand Commerce and Industry Office may facilitate
the issue of up to 400 work visas per annum to Taiwan applica-
nts who satisfy all requirements in paragraph 2.
4.The New Zealand Commerce and Industry Office will facilitate
the grant of a work permit to a person from Taiwan provided
that he/she holds the work visa issued pursuant to paragraph 2
. The work permit will be granted to such a person on his/her
initial arrival in New Zealand and will be valid for a period
of not more than twelve (12) months from the date of entry
into New Zealand.
5.All persons from Taiwan who have entered New Zealand through
the Scheme described in this Arrangement will be required to
comply with the laws and regulations of New Zealand and not to
engage in employment that is contrary to the purpose of the
Scheme. Participants in the Scheme are not permitted to enga-
ge in permanent employment during their visit and should not
work for the same employer for more than three (3) months dur-
ing their visit. They may enrol in one training or study cou-
rse of up to three (3) months duration during the course of
their visit to New Zealand.
Responsibilities of the Taipei Economic and Cultural Offices in
New Zealand
6.The Taipei Economic and Cultural Offices in New Zealand may,
subject to this paragraph, facilitate the issue of a visitor
visa for working holiday makers (hereinafter referred to as a
"working holiday visa") valid for a period of twelve (12) mon-
ths from the date of issue to any applicant from New Zealand
who satisfies each of the following requirements:
(a) is a person who holds a New Zealand passport valid for more
than twelve (12) months upon arrival in Taiwan;
(b) satisfies the visa officer that his/her primary intention
is to holiday in Taiwan, with employment being an incidental
rather than a primary reason for the visit, and will depart
Taiwan at the end of the visit;
(c) is aged between eighteen (18) and thirty (30) years, both
inclusive, at the time of application;
(d) has no accompanying children;
(e) holds a return ticket, or sufficient funds to purchase such
a ticket;
(f) holds sufficient funds for his/her maintenance during the
period of stay in Taiwan, at the discretion of the relevant
authorities;
(g) pays the prescribed visa application fee;
(h) holds valid medical and comprehensive hospitalisation insur-
ance throughout his/her stay in Taiwan;
(i) has not been a previous recipient of a Taiwan working holid-
ay visa.
7.The Taipei Economic and Cultural Offices in New Zealand may
facilitate the issue of up to 400 working holiday visas per
annum to New Zealand applicants who satisfy all requirements
in paragraph 6 permitting the holders to engage in paid emplo-
yment. Employment in a profession is dependent upon recogniti-
on of qualification and any rules of registration for practice
in that profession.
8.The working holiday visas shall be valid for twelve (12) mont-
hs and good for multiple entries. The initial duration of stay
under the visas is 180 days, which may be extended for no more
than another 180 days while the visa is still valid. The perm-
itted work period should not exceed the validity of the visa.
9.All persons from New Zealand who apply for entering or have
entered Taiwan under this Scheme will be required to comply
with the laws, regulations, and statutes of Taiwan and cannot
engage in employment that is contrary to the purpose of the
Scheme. Participants in the Scheme are not permitted to enga-
ge in permanent employment during their visit and should not
work for the same employer for more than three (3) months dur-
ing their visit. Participants under this Scheme cannot undert-
ake any formal courses other than Chinese language courses in
Taiwan of no more than three (3) months duration.
General Provisions
10.Either of the parties may refuse any particular application
it receives.
11.Either of the parties may refuse the entry into its territory
of any person participating in the Scheme whom it may consid-
er undesirable, or remove any such person from its territory
who has obtained entry under this Arrangement (consistent wi-
th its own law).
12.Either of the parties may, at any time, request consultations
on the provisions of this Arrangement. The other party will
respond to the request within 60 days. The Arrangement will
be subject to a review after a period of one (1) year from
the date it comes into effect, and subsequently as requested
by either party.
Suspension of the Arrangement
13.Either of the parties may temporarily suspend the Arrangement
, in whole or in part, for reasons of public security, public
order, public health or immigration risk. Any such suspensi-
on, and the date of its effect, will be notified to the other
party as soon as possible.
Termination
14.Either of the parties may terminate this Arrangement by givi-
ng three (3) months prior written notice to the other party.
Entry into Effect
15.This Arrangement will come into effect on the first day of
June, 2004.
This Arrangement has been signed in duplicate in the English and
Chinese languages, each text being equally authentic.
