法規名稱: AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF CHINA AND THE GOVERNMENT OF THE REPUBLIC OF MALAWI ON MEDICAL COOPERATION

The Government of the Republic of China and the Government of t-
he Republic of Malawi (hereinafter referred to as the "Contract-
ing Parties");
BEING desirous to strengthen and consolidate the existing frien-
dly relations between the two countries; and
WISHI NG to promote medical cooperation;
HEREBY AGREE as follows:

ARTICLE I
(1) The Government of the Republic of China, at the request of
the Government of the Republic of Malawi, agrees to dispatch
a Medical Mission of ten to fifteen personnel (hereinafter
referred to as the Mission) to serve in the Central Hospital
at Mzuzu City in the Republic of Malawi.
(2) The expertise of the Mission members shall be decided by the
Contracting Parties.

ARTICLE II
(1) The purpose of the Mission is, under the close cooperation
with the medical personnel of the Central Hospital at Mzuzu
City, to undertake therapeutic and preventive medical activ-
ities and offering consultative medical service.
(2) The Mission shall not engage in matters relating to forensic
medicine.

ARTICLE III
The Government of the Republic of Malawi agrees to provide expe-
nditures, medical personnel and administrative support necessary
for the operation of the Central Hospital at Mzuzu City.

ARTICLE IV
The Government of the Republic of China agrees to pay travel e-
xpenses for members of the Mission to and from the Republic of
Malawi, and their salaries, allowances, insurance fees and local
transportation in the Republic of Malawi.

ARTICLE V
The Government of the Republic of Malawi agrees to:
(1) provide members of the Mission, free of charge, furnished h-
ousing and offices in the compound of the Central Hospital
at Mzuzu City;
(2) exempt members of the Mission from taxes on their salaries
and allowances earned from outside Malawi;
(3) exempt members of the Mission and their dependants from all
import tariffs, duties and other taxes on their personal and
household effects for a period of six months beginning from
their arrival in the Republic of Malawi. The members of the
Mission will also be exempted from export tariffs, duties
and other taxes for personal effects shipped out of the Rep-
ublic of Malawi at the end of their service;
(4) exempt the Mission from all import tariffs, duties and other
taxes on the medicine, medical equipment, machinery and oth-
er materials required for the work of the Mission and facil-
itate customs clearance ; and
(5) provide adequate security to members of the Mission and gr-
ant them the same courteous treatment as is accorded to the
personnel of any third nation or of any international org-
anization serving in the field of technical cooperation in
the Republic of Malawi.

ARTICLE VI
(1) The Government of the Republic of China agrees to provide s-
pecialist training to Malawian medical doctors selected by
the Government of the Republic of Malawi. The selected Mala-
wian trainees must have at least one year of clinical pract-
ice experience at a medical institution to qualify for atte-
nding the training program. The Malawian trainees may perfo-
rm medical services necessary for their training under the
instructions of and supervision by the medical doctors of t-
he Republic of China. The number of Malawian trainees and t-
he content of the training courses shall be decided by the
Contracting Parties. The Malawian trainees shall meet the q-
ualifications set down by the Contracting Parties in accord-
ance with their respective laws and regulations and shall n-
ot bring their dependants to live with them in the Republic
of China during their training period.
(2) The Government of the Republic of China shall pay the travel
expenses of Malawian participants to and from the Republic
of China, their living and training expenses as well as med-
ical and accident insurance fees during their stay in the R-
epublic of China.
(3) The Malawian participants shall obey the regulations set do-
wn by the training institution during their stay in the Rep-
ublic of China.
(4) The Government of the Republic of China agrees to subsidize
the Malawian participants travel expenses to and from the R-
epublic of China once to visit their dependants in Malawi a-
fter they have stayed in the Republic of China for one year.
ARTICLE VII
(1) The Malawian participants mentioned in Article VI should fu-
lfill the obligation to return to the Republic of Malawi to
serve at the Central Hospital in Mzuzu City or at the insti-
tution assigned by the Government of the Republic of Malawi
after they have completed the training courses in the Repub-
lic of China. The period of their compulsory service shou-
ld be equal to that of their training courses.
(2) The Government of the Republic of China agrees to pay, thro-
ugh the Embassy of the Republic of China to the Republic of
Malawi, monthly encouragement allowances to the Malawian do-
ctors who will serve compulsorily. It also agrees to confer
on them certificates of medical doctor training after they
have completed their compulsory service.

ARTICLE VIII
Members of the Mission should be entitled to have the public ho-
lidays stipulated by the Contracting Parties in addition to the-
ir annual leave.

ARTICLE IX
The Contracting Parties should handle matters not stipulated in
this Agreement or settle any dispute during the validity of this
Agreement by means of friendly consultation.

ARTICLE X
This Agreement may be amended by mutual consent by the Contract-
ing Parties through the exchange of diplomatic notes.

ARTICLE XI
This Agreement shall enter into force on the date of signature
by the Contracting Parties and shall remain valid until December
31, 2004. This Agreement may be extended upon mutual consent of
the Contracting Parties through the exchange of diplomatic notes
.
IN WITNESS WHEREOF, the undersigned, duly authorized thereto by
their respective Governments, have signed this Agreement.
DONE in duplicate in Chinese and English, both texts being equa-
lly authentic, at Blantyre on this sixteenth day of the second
month of the ninetieth year of the Republic of China, corresp-
onding to the sixteenth day of the second month of the year t-
wo thousand and one.
