法規名稱: MEMORANDUM OF UNDERSTANDING BETWEEN THE GOVERNMENT OF THE REPUBLIC OF CHINA (TAIWAN) AND THE GOVERNMENT OF THE FEDERATION OF ST. CHRISTOPHER AND NEVIS ON HUMAN RESOURCES DEVELOPMENT

WHEREAS the Government of the Republic of China (Taiwan) takes
great assurance in the appreciation expressed by both the people
and the Government of the Federation of St. Christopher and
Nevis on the successful implementation of the Human Resources
Development Program (hereinafter referred to as “ the Program
” )over the last twenty years;

WHEREAS the Program has contributed tremendously to the
development of human resources and has benefitted both teachers
and students in the Federation at all levels;

WHEREAS the Government of the Republic of China (Taiwan) is
desirous of assisting the Federation in laying the foundation
for its national development by nurturing professionals at the
grass roots level;

AND DESIRING to deepen their cordial relations established since
1983 and strengthen the mutually beneficial cooperation in the
area of human resources development;

NOW THEREFORE the Government of the Republic of China (Taiwan)
and the Government of the Federation of St. Christopher and
Nevis (hereinafter referred to as “ the Parties ” ), have
agreed as follows:

ARTICLE 1
PURPOSE
The Parties agree to extend the Program from 2019 to 2023.

ARTICLE 2
ASSISTANCE PROVIDED
The Government of the Republic of China (Taiwan) shall provide
an annual budget of up to one hundred and twenty thousand
dollars United States Currency (US$120,000.00) depending on the
needs of the development programs of the Federation of St.
Christopher and Nevis, for such initiatives as student
scholarships, teacher training, high school agricultural
vocational training and other areas of training identified by
the Parties.

ARTICLE 3
DESIGNATION OF REPRESENTATIVE
3.1 For the purpose of this Memorandum of Understanding and any
activities in connection thereto the Government of the
Federation of St. Christopher and Nevis will be represented
by the Ministry of Education, Youth, Sports and Culture
(hereafter referred to as “ the Ministry ” ).
3.2 The Ministry shall be responsible for preparing and
presenting proposals for development programs to be funded
by the Program in each year.

ARTICLE 4
IMPLEMENTATION
4.1 The Program shall be implemented according to the budget
available in each year and the development program proposals
identified for funding from the Program by the Parties after
consultation with each other.
4.2 The specific details of any development program which shall
be funded by the Program may be set forth in agreements
supplemental to this Memorandum of Understanding, and the
terms of which will be subject to the mutual approval of the
Parties.
4.3 The Parties acknowledge and agree that, for the purpose of
fulfilling their respective obligations pursuant to this
Memorandum of Understanding, they may share personal
information of parties taking part in the development
programs contemplated by this Memorandum of Understanding.
The Parties mutually covenant and agree that they will treat
any such personal information in strict compliance with
their local law.
ARTICLE 5
DISPUTE RESOLUTION
Any dispute that arises in connection with the application or
interpretation of this Memorandum of Understanding or any
agreement contemplated by Article 4.2, shall be resolved by
direct negotiations between the Parties.

ARTICLE 6
ENTRY INTO FORCE, AMENDMENT AND TERMINATION
6.1 This Memorandum of Understanding shall come into effect on
January 1, 2019, remain effective for five years, and expire
on December 31, 2023.
6.2 This Memorandum of Understanding may be amended at any time
by mutual written consent of the Parties.
6.3 This Memorandum of Understanding may be terminated by
written notice of either Party, effective thirty (30) days
after notice of termination has been given to the other
Party.
6.4 The term of this Memorandum of Understanding may be extended
by written agreement for such further period as the Parties
may determine.

IN WITNESS WHEREOF, the undersigned, being duly authorized by
their respective Governments, have signed this Memorandum of
Understanding.

Done in duplicate in the Chinese and English languages, both
texts being equally authentic, in Basseterre on the 14 day of
August of the year 2019 of the Gregorian Calendar.
