KNOW ALL MEN BY THESE PRESENTS:
This understanding made and entered into at Makati, Metro Manila
, this 2nd day of July 1994 between:
The Manila Economic and Cultural Office, with office address at
4th floor, Metrobank Plaza, 107 Chung Hsiao East Road, Section 4
, Taipei, hereinafter referred to as PARTY A and represented he-
rein by REPRESENTATIVE MANUAL R.TAYAS.
The Taipei Economic and Cultural Office with office address at 2
8th Floor, Pacific Star Building, Sen. Gil J. Puyat Avenue, Mak-
ati, Metro Manila, hereinafter referred to as PARTY B and repre-
sented herein by DIRECTOR CHYAN YIH-MA.
WITNESSETH THAT:
Whereas it is the common desire of both sides to strengthen and
enhance economic relations between the two Parties.
Whereas,it is the intention of the authorities represented by b-
oth Parties to foster stronger economic cobperation through the
promotion and enhancement of business opportunities specifically
in the field of textile and garment industries.
Whereas, both Parties have textile and garmet quota allocations
under existing bilateral agreements with other countries wherein
importations of textiles and apparel are subject to quota restr-
ictions.
Whereas, both Parties recognize the need for greater cooperation
and closer coordination to maximize the utilization of their re-
spective quota allocations to sustain the growth and development
as well as the competitiveness of their respective textile and
garrnent industries through increased investments and exports f-
or their mutual benefit.
Now, Therefore, for and in consideration of the foregoing premi-
ses, the Manila Economic and Cultural Office and the Taipei Eco-
nomic Cultural Office have agreed on the following:
1.Promote investments and increase exports through the following
arrangements:
a.Prospective investors from Party B shall be guaranteed by t-
he authorities of Party A's underutilized textiles and garm-
ents quota allocation as identified in the list hereto atta-
ched.
b.To encourage prospective investors from Party B to invest in
the yarn and fabric industry in the Philippines, the author-
ities of Party A shall guarantee not only the quota allocat-
ions of yarn and fabric but also the quota allocations of t-
he designated garment categories in the attached list as an
added incentive.
c.To encourage investors from Party B in the textile and garm-
ent industry to undertake processing activities in the Phil-
ippines in accordance with the existing Regulations Governi-
ng Outward Processing in Party B, both Parties shall assist
investors to secure favorable binding rulings of origin from
importing countries.
d.Both Parties shall, through joint undertaking,forge favorab-
le arrangements with importing countries to secure their ac-
ceptance on the quota swap agreement between the Parties. U-
pon acceptance by any importing country of the quota swap a-
greement, both Parties agree to enter into negotiations to
implement the quota swap arrangement.
2.The quota categories and quantities under the foregoing arran-
gements shall be subject to review every two (2) years by both
Parties or sooner as the need arises. Furthermore,should eith-
er Party see the needfor the alteration/modification/amendment
of the quota category schedule before' the lapse of the two y-
ear period, the Party requesting for the alteration/modificat-
ion/amendment shall notify the affected Party in writing one (
1) month before the proposed meeting for the amendment of the
quota schedule.
3.Each Party agrees to supply information necessary to facilita-
te the implementation of this Memorandum of Understandiog upon
request by the other Party.
This Memorandum of Understanding shall be effective upon sign-
ing of the herein Parties.
IN WITNESS WHEREOF, the PARTIES hereto have signed this Memor-
andum of Understanding on this 2nd day of July 1994 at Makati,
Metro Manila.
