Article 1
These Regulations are in accordance with the provisions of Article 39 of the Animal Infectious Disease Prevention and Control Act (hereinafter referred to as the Statute).
Article 2
2.1 For the purposes of these Regulations, "closed container" shall be defined as a closed container for transporting animal products, and it must meet the following conditions:
2.1.1 It must be strong enough in structure and shall be reusable.
2.1.2 Its door must be closed thoroughly during transport.
2.1.3 It must be able to prevent any pathogen of animal infectious diseases from leaking outward or entering into during transport.
2.1.4 It must be easy to clean and sanitize.
Article 3
3.1 During the transport process, if the shipment of the closed container is transported or transshipped through countries or zones declared as animal diseases infected countries (zones) by Taiwan’s central competent authority according to Paragraph 1, Article 33 of the Statute, or at their port or airport, the importation shall only be permitted if the following conditions have been met:
3.1.1 The original seal with imprinted number shall be placed at the opening of the closed container before leaving the exporting country.
3.1.2 The animal health certificate or the bill of landing issued by animal quarantine authority of the exporting country shall state the numerical code of the closed container and its seal.
3.1.3 The changing of the original closed container seal shall be done within the borders of the country (zone) passed through which has been recognized by Taiwan’s central competent authority as being free from animal diseases, or on the transportation means.
3.2 In the case of the closed container where there is a changing of the original seal described in the Article 3.1.3, the importer or its agent shall apply for animal quarantine according to Paragraph 1, Article 34 of the Statute and submit the certified documents in English issued by the following officials with the seal numbers before and after changing. If the container is changed at the same time, the certified documents in English shall also state the container numbers before and after changing.
3.2.1 The original seal is changed within the borders of the country (zone) passed through which has been recognized by Taiwan's central competent authority as being free from animal iseases: issued by the animal quarantine authority, customs, port authority, or relevant competent authorities of the government.
3.2.2 The original seal is changed on the transportation mean: issued by the captain of the sea vessel or the air vessel.
3.3 If the documents mentioned in Article 3.2 are not in English, the documents shall be verified by the Embassy or Representative Office of our country (Taiwan, the Republic of China, R.O.C.) and an English translation shall be submitted.
3.4 According to Paragraph 1, Article 34 of the Statute, the animal quarantine inspector may checkup the integrity of the original seal of the closed container when the importer or its agent applies for animal quarantine. If the original seal of the closed container is to be changed upon arrival, prior to the application of animal quarantine, the importer or its agent must apply to the Customs for issuing a document of "Record of Opening of the Original Seal of Container" for verification.
Article 4
4.1 When any of the following conditions occur, it will be viewed as a closed container:
4.1.1 Importation of animal feed, dog and; cat food containing ingredients derived from bovine by air or sea transport shall comply with the relevant quarantine requirements and one of the following conditions:
4.1.1.1 The product shall be processed through high-temperature sterilization canning procedure (including retort pouch packaging)
4.1.1.2 The product is in the original sealed packaging. The product has been confirmed without being opened, damaged or contaminated by pathogens of animal infectious disease during on-site inspection.
4.1.2 Importation of processed products containing meat, dog and cat food without ingredients derived from bovine, straw or forage as animal feed and dairy productsby air or sea transport shall comply with the relevant quarantine requirements. The product shall also be sealed in the original packaging, without being opened or damaged and not contaminated by pathogens of animal infectious disease during on-site inspection.
4.1.3 Importation of animal products except for those mentioned in Article 4.1.1 and Article 4.1.2 by air transport shall comply with the relevant quarantine requirements and one of the following conditions:
4.1.3.1 The container of the products shall be completely closed, free from damaged, leakage, overflow and not contaminated by pathogens of animal infectious disease. Each opening location of the product shall be sealed properly by original seals with numbers.
4.1.3.2 The veterinary certificate or the bill of lading shall state the original seal number.
Article 5
These regulations shall be implemented on the date of promulgation.
