Title: Meteorological Act CH

CHAPTER I GENERAL
Article 1
This Act is specifically enacted in order to enhance meteorological services and to improve the observing and forecasting systems. Items not covered under this Act are to be referred to other laws and/or regulations.
Article 2
The terms used in this Act are defined as follows:
1. METEOROLOGICAL OPERATION Observations of meteorological, seismological, and marine meteorological phenomena, collection of data thereof, and issuance of the analysis and evaluation of such data.
2. METEOROLOGICAL PHENOMENON Atmospheric phenomena of all types.
3. SEISMOLOGICAL PHENOMENON The shaking of ground and other related phenomena caused by stratum dislocation or volcanic activities.
4. MARINE METEOROLOGICAL PHENOMENON Tides, waves, and other natural phenomena existing on the interface between the atmosphere and the sea.
5. WEATHER MODIFICATION The act of utilizing scientific technology to modify weather phenomena.
6. OBSERVATION The observing and measuring of meteorological, seismological, or marine meteorological phenomena.
7. METEOROLOGICAL FACILITY OR EQUIPMENT Facility or equipment necessary for engaging in or carrying out meteorological operations.
8. OBSERVATION STATION Observation facility installed in a suitable place for observations of meteorological, seismological, or marine meteorological phenomena.
9. OBSERVATION GROUNDS A specified outdoor patch for installation of surface meteorological observation instruments.
10. RADIOSONDE TRACKING DEVICE Observation facility or equipment which installs a tracking antenna on top of a weather station building for tracking and receiving the observation data collected by balloon-carried radiosonde(s)
11. WEATHER RADAR ANTENNA Observation facility or equipment which installs a specific type of antenna on top of a weather radar station for transmitting and receiving radar signals.
12. POLAR-ORBITING METEOROLOGICAL SATELLITE TRACKING ANTENNA Observation facility or equipment which installs a specific type of antenna on a building for receiving polar-orbiting meteorological satellite images and remote sensing data.
13. HAZARDOUS WEATHER Weather phenomena which may cause loss of life and property such as typhoon, heavy rain, torrential rain, thunder and lightning, hail, dense fog, tornado, high wind, low temperature, foehn, drought, etc.
14. FORECAST Issuance of observation-based predictions of meteorological, seismological, or marine meteorological phenomena.
15. WARNING Forecast issued to warn of meteorological, seismological, or marine meteorological phenomena which are predicted to be potentially hazardous.
16. OBSERVATION INSTRUMENT Observation equipment for use in meteorological operations.
17. EXCLUSIVE OBSERVATION STATION CWB-approved facility with observation instruments installed in a suitable place for use by government agency, institution, organization, or individual for scheduled observations for business application or academic research purposes.
Article 3
The authority governing this Act is the Ministry of Transportation and Communications (hereinafter referred to as MOTC).
The meteorological services shall be conducted by the Central Weather Administration (hereinafter referred to as CWA) of the MOTC.
Article 4
For the purpose of promoting international cooperation in meteorological services, the MOTC may establish meteorological cooperative agreements and/or exchange meteorological data with foreign meteorological authorities or agencies on the basis of mutual benefit.
The MOTC may entrust private organizations with the execution of the preceding issues.  Such private organizations may act on behalf of the government to negotiate with foreign or international meteorological organizations about meteorological services and/or to sign relevant agreements.  The agreements shall be established in compliance with the appropriate laws and/or regulations.
Article 5
The CWA may provide data of meteorological, seismological, or marine meteorological phenomena, or specified meteorological services to a government agency, institution, organization, or individual for research or application purposes.
Article 6
A government agency, institution, organization, or individual would like to undertake a weather modification program shall obtain approval from the MOTC in advance.  The MOTC may dispatch a representative to supervise the modification process.
The MOTC may rescind the preceding approval it has granted if the government agency, institution, organization, or individual fails to undertake the program or refuse the supervision.
