Chapter 3 Establishment Procedure for Dedicated Telecommunications Network and Examination
Section 1 Application for Establishment of Public Service Network Radio Station and Examination
Article 13
A public service network establisher who intends to apply for the establishment of radio station shall prepare and submit the following documents according to the approved network establishment proposal to the competent authority for approval of radio station establishment; a letter of radio station establishment approval shall be issued by the competent authority upon approval:
1. Application form for radio station establishment containing type of station, place of establishment, frequency, bandwidth, transmission power, quantity, brand, model and technical specifications;
2. Photocopy of frequency use certificate;
3. Approved network establishment proposal;
4. Other document(s)required by the competent authority.
For those who file an application mentioned in the preceding paragraph for the establishment of intelligent metering system for dedicated frequencies used for utility services, the document proving that the radio transmission or transceiver equipment proposed has been issued a type certificate or approval by the competent authority.
The station establishment approval mentioned in Paragraph 1 is valid for six(6)months; and its period of validity shall not exceed that of the frequency use certificate.
Article 14
For failure of establishment before the station establishment approval expires, the public service network establisher may state the reason and submit the application to the competent authority for extension in one(1)month prior to the expiration. The extension is valid for six(6)months at most and only one(1)extension shall be granted; the period of validity of frequency use certificate shall not be exceeded.
Article 15
Upon the establishment of radio station, the public service network establisher shall prepare and submit the following documents to the competent authority for inspection; the radio station license shall be issued after passing the inspection:
1. Inspection application form and list(electronic file);
2. Letter of radio station establishment approval;
3. Inspection item record and self-evaluation report.
For dedicated telecommunications networks where an MMSI number is used, the photocopy of MMSI approval certificate shall be provided in addition to the documents to be provided as mentioned in the preceding paragraph.
For failure of inspection, the public service network establisher shall improve and apply for a second inspection in one(1)month from the day that the notification from the competent authority is received; for failure to improve by the deadline or failure to pass the second inspection, the application shall be rejected. The public service network establisher may reapply for inspection provided that the radio station establishment approval is still valid.
Article 16
The inspection on the radio station of the public service network establisher conducted by the competent authority is performed in principle in the form of document review; samples may be taken if necessary.
Article 17
For the application for inspection to the competent authority pursuant to Article 15, the public service network establisher shall provide the test equipment and necessary assistance needed for the inspection as required by the competent authority.
